The law is changing. After 30 June 2021, the new immigration rules for recruiting people from outside the UK will apply.
You’ll also need a sponsor licence to employ EEA and Swiss citizens coming to the UK to work from 1 January 2021. You must check that a job applicant is allowed to work for you in the UK before you employ them.
You can either:
- check the applicant’s original documents
- check the applicant’s right to work online, if they’ve given you their share code
You could face a civil penalty if you employ an illegal worker and have not carried out a correct right to work check. You must not discriminate against anyone because of where they’re from.

Alison Green
UK Civil ServantAlison is a former UK Civil Servant with over 30 years experience in the field of immigration with extensive knowledge of operations, training, policy and project delivery. She has worked at the highest levels within immigration and also with Government Ministers and has a sound understanding of strategic thinking. Alison took early retirement in July 2020 after almost 34 years with the UK Home Office, having worked in numerous locations including central London, Scotland and Northern Ireland. Her operational experience covers many years on the front line of immigration operations in both Border Force and Immigration Enforcement where she was recently the operational manager of the enforcement capability for the whole of Scotland and Northern Ireland. Alison is also an experienced trainer, having trained new entrant immigration officers for a number of years as well as delivering subject specific training to existing staff. She was instrumental in the creation of a brand new training unit in Manchester and also assisted in the development of a learning and development schedule for a new grade of operational staff.
Shaun Anton
Intelligence ManagerShaun Anton has over 41 years’ expertise in identity and border management, within the UK Home Office passport and Immigration services. As Intelligence Manager at the Heathrow Immigration Intelligence Unit he was responsible for developing intelligence and strategies to combat transnational organised immigration crime. He worked with industry and other commercial partners to develop the operational and profiling capabilities, which included design and implementation of an electronic alert system to primary control points at Heathrow. As country manager for Bangladesh he was primarily involved in investigating abuse of Tier 2 and Tier 4 points-based processes and visa applications, including the drafting of recommendations for the suspension and revocation of sponsor licenses, and gathering evidence for the prosecution of offenders. As a trainer, Shaun has developed a wide range of bespoke courses in relation to border control and identity management. He has delivered training on behalf of UN and non-governmental organisations in the Middle East & Levant, ASEAN region and Indian Sub-continent.
