When to use Employer Checking Service

  1. Your employee cannot show you their documents because of an outstanding appeal, review or application with the Home Office.
  2. They have an Application Registration Card.
  3. They have a Certificate of Application that’s less than 6 months old.
  4. They are a Commonwealth citizen who started living in the UK before 1988.

 You must ask the Home Office to check an employee’s or potential employee’s immigration status if any of the above applies.

As a business you will need to get the employee or potential employee’s permission to make the check via Employer Checking Service.

You’ll need to provide the following information to request a Right to work in the uk checks.

Your employee’s or potential employee’s:

  1. Full name of the employee
  2. Date of birth
  3. Nationality
  4. Job title
  5. Hours worked per week
  6. Home address
  7. Home Office reference number or case ID (if they have either)

You’ll also need to provide your:

  1. Business name
  2. Business type
  3. Business contact information

You can be fined up to £20,000 for employing illegal workers or can be sent to jail for 5 years, if you’re found guilty of employing someone who you knew or had ‘reasonable cause to believe’ did not have the right to work in the United Kingdom.
